1. Introduction
These terms and conditions (“terms”) govern your purchases from, and your use of, the www.monofore.com website (the “Website”) and forms a contract between you and Monofore Limited, a company registered in England and Wales with registration number 10360832 and VAT number 337118901 whose registered address is Second Floor, 105 Heath Street, London, NW3 6SS (hereafter “Monofore”).
Please read our terms carefully. These are the terms by which we sell goods to you. By making a purchase from, and using, the Website, you are agreeing to be bound by these terms.
2. Ordering
The order process is clearly set out on our website. The order process allows you to check and amend any details that you have entered incorrectly before submitting your order to us.
Once we have received your order, we will send a confirmation email to your email address. It is therefore important that you enter the correct email address when placing your order. A contract of sale is only formed when we have sent you an email confirming your order. The order confirmation serves as your proof of purchase.
If we are unable to accept your order, we will inform you of this by email and we will not process your order. This might be because the product is out of stock, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified. If you have already paid for the product, we will refund you the full amount including any delivery costs charged as soon as possible.
We reserve the right to refuse an order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.
We reserve the right to cancel any order that we deem to be fraudulent. We may choose to pass on the details of any fraudulent activity to the UK authorities.
3. Payment
You can pay with credit or debit cards, PayPal, Google Pay, Apple Pay and Klarna.
Credit and debit card payments are handled by Stripe using secure encryption. Your card details are sent directly to the bank and cannot be accessed by anyone other than your bank. There is no extra charge for card payments. In the event that no payment has been received after submitting your order, Monofore may automatically cancel your order.
4. Pricing
We always try to make sure that the prices on the Website are accurate but errors may occur. Monofore holds the right to change prices in the Website without advance notice and has the right to correct incorrect prices on all orders. If a price is incorrect, Monofore has the right to cancel the purchase and refund any amount paid in the best way. This can be performed at any time.
5. Taxes
We cover duties and taxes on all orders placed through the Website, so you will not be liable for any additional fees upon delivery.
6. Delivery
All goods purchased through the Website are shipped from the UK. The majority of orders are shipped with DHL.
An estimate of the delivery times for different regions is displayed during the checkout process. Delivery times are estimates only and cannot be guaranteed. They are also subject to matters beyond our reasonable control. We cannot be held responsible for any delay to the delivery of goods.
The cost of shipping varies depending on the region we are shipping to. Full details of the cost of shipping can be found on the Payment and Shipping page on the Website.
Refused packages, including those not received due to negligence on the part of the customer are refunded once received back to us, less the cost of return shipping and any applicable duties and taxes.
You are the legal owner of the goods once the goods have been delivered to the address you specified at the point of order and once we have received payment in full. This means that from the time of delivery you will be responsible for care of the product and you must bear the cost of any loss of and/ or damage to the product.
7. Returns and Cancellations
In addition to your statutory rights in respect of faulty products, you have the right to cancel your order within 14 days from the day on which you receive the goods. The right applies only in the case that the product and its original packaging is returned in the same condition as when received. If you exercise your right to cancel your order, you should email us at info@monofore.com in order to let us know. We offer free returns for customers in the UK. Customers based outside of the UK are responsible for the costs of returning the goods to our chosen UK address. You are legally required to return the goods to us within 14 days of notifying us that you would like to cancel your order.
If we have sent you the wrong goods, or they are faulty, then we will pay for the return of the goods.
Customers are advised to get a receipt and tracking number from the courier for the return delivery. We cannot take any responsibility for items lost during return shipping.
If you are returning an item from outside of the UK, please mark your package ‘RETURNED GOODS’ to avoid any customs duties. We cannot be held responsible for any customs charges applied to your return and will have to deduct any charges from your refund.
We will make the refund within 10 days of receiving back from you any goods supplied. We will make the reimbursement using the same method as you used for payment.
8. Warranty
Monofore watches come with a two-year warranty valid from the date of purchase when bought directly from us. This covers manufacturing defects, not the strap or battery. This warranty warrants that we will at our option repair, replace or refund the costs of the defective product. To make a claim under the warranty, please email us at info@monofore.com. In the email, you must specify your name, address, order number, and a description of the defect.
This warranty does not cover:
- Failure or damage caused by improper use or carelessness.
- Failure or damage caused by unjustifiable repair or modification.
- Failure or damage caused by fire or water.
- Aesthetic changes that occur during normal wear and tear.
9. Product
Monofore has the right to adjust prices and change product information on the Website without notice. The images of the product and information texts on the Website are for illustrative purposes only. While we have made every effort to display as accurately as possible the colours of our products, we cannot guarantee that your computer’s display of the colours will be accurate.
10. Liability
We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. We do not exclude or limit in any way our liability to you where it would be unlawful to do so.
We are not liable for business losses. We only supply goods for private use. If you use them for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, or loss of business opportunity.
11. Force Majeure
Monofore shall be exempt from liability for damages and other penalties for any failure to perform, or delay in performance of, any of our obligations under a contract with you that is caused by circumstances beyond our control.
12. Personal Information
When shopping on the Website, Monofore will save some of your data to fulfil your purchase. We treat all personal information confidentially. You have the right to request access to your data and if there is anything wrong you can have it changed or removed. Monofore may also use cookies in order to improve your experience of the Website. 13. Intellectual Property Rights
All intellectual property rights, such as trademarks and copyright, on the Website and in the content published on it are owned by Monofore. Any use of the Website or its content, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of Monofore.
14. Retention of Title
All products remain Monofore’s property until full payment is made.
15. Governing Law
These terms are governed by English law. You and Monofore agree to the exclusive jurisdiction of the courts of England. However, if you are a resident in Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident in Scotland you may also bring proceedings in Scotland.
16. Amendments
Monofore may revise these terms from time to time. Every time you order a product from us, the terms in force at that time will apply to the contract between you and Monofore. You should therefore periodically visit this page to review the current terms to which you are bound.
